BEFORE: LIVELY, Chief Judge; MERRITT, Circuit Judge; and GIBBONS, District Judge* Order This appeal has been referred to a panel of the Court pursuant to Rule 9(a), Rules of the Sixth Circuit. The appellant has filed a brief, and the appellee filed a motion to remand in light of Haynes v. Secretary of Health and Human Services, 734 F.2d 284 (6th Cir. 1984). After examination of the record, appellant's brief and appellee's motion, the panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure. Mrs. DiGregorio is appealing from the judgment of the district court which found the Secretary's termination of her social security disability benefits and medicare health coverage benefits supported by substantial evidence. The appellant had previously been granted a hearing before an administrative law judge, who also entered an opinion finding the appellant no longer disabled. Where the claimant has been initially found to be disabled, the Secretary has the burden of showing substantial evidence of improvement in the claimant's condition to the extent that he is presently able to engage in substantial gainful employment.
